This limitation applies regardless of the theory of liability, whether in contract, tort, or otherwise. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.

EmberPlanet operates in accordance with Portuguese financial services regulations and professional standards. Our services are subject to regulatory oversight, and we maintain appropriate professional qualifications and insurance. Clients acknowledge that financial advisory services involve inherent risks, and past performance does not guarantee future results. We provide advice based on information available at the time and cannot guarantee specific outcomes or investment returns.

11. Force Majeure

EmberPlanet shall not be liable for any delay or failure to perform our obligations under these Terms if such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, epidemics, or failures of third-party systems or services.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Portugal. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the Portuguese courts. For clients located in other European Union member states, mandatory consumer protection laws of your country of residence may also apply where applicable.

If formal dispute resolution is necessary, we are committed to participating in good faith mediation before pursuing litigation. For qualifying disputes, clients may also have access to alternative dispute resolution mechanisms provided by Portuguese financial services regulators.

14. Termination

Either party may terminate the advisory relationship or website access in accordance with the terms specified in individual service agreements. EmberPlanet reserves the right to suspend or terminate access to our website or services immediately if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to our business or other users. Upon termination, you must cease all use of our services and return or destroy any confidential information. Provisions regarding confidentiality, intellectual property, limitation of liability, and governing law shall survive termination.
